Consent
A recipient needs to have given his or her consent to receive marketing messages from you.
Consent can be implied or express. Express consent is where the recipient has stated that they agree to receive messages from you. Implied consent is where the recipient has bought a product, or has begun the process of buying a product from you in the past (not too distant past). Alternatively if there was no purchase but the recipient knows why, or can be reasonably expected to know why you are sending a message to them then you do not need their express consent to send a message; so long as point two below is adequately dealt with.Identity
A recipient needs to be able to identify and if necessary contact the sender of the messages.
It is important that as the sender of messages that you identify yourself in each message or in each batch of messages and provide a simple & free method of contact; this can be an email address or a standard rate telephone number. When a consumer withdraws their consent you must not send them any further marketing unless they opt in to receiving marketing messages once again.
It is advisable to maintain an audit of how and when consumers opted into receiving marketing messages if this is not through mobile originated SMS.
Unsubscribe
A recipient needs to have the means to stop receiving marketing messages from you (e.g. in the event that a number is on your mailing list which should not be there or, the recipient no-longer wishes to receive messages from you).
You should include in each message (where this is appropriate e.g. where you are sending a number of messages together there is no requirement to place this line in each message) a phrase stating something similar to, “To stop messages reply with STOP”. Where this is not possible (because the messages are only delivered one way) then the recipient needs a simple & free way to contact you in order to be removed from the recipient list. This method needs to be made clear to the recipient regularly within messages and can be a free-phone telephone number or even an email address.
